Butterfly by Subbi

Terms of Service

Effective 18 August 2026 · Version 2026-08-18 · Applies to the Butterfly iOS app and the Butterfly web console

The short version

Who this agreement is between

Butterfly is built and operated by Subbi Technologies Inc. (“we”, “us”). This agreement is between us and the company or contractor whose account is being created (“your company”, “you”). Questions: [email protected].

What you are agreeing to

Butterfly replaces the hand-drawn “butterfly diagram” manhole-inspection paperwork: your crews photograph and record inspections in the field, and the results flow to your company’s space in our service.

By accepting these terms and creating a company account, your company authorizes us to store and process its inspection records on its behalf — the work orders, manhole inspections, condition notes, and photographs your crews capture, including the names of the people who carried out each inspection — for the purpose of providing the service described here and in our Privacy Policy.

The Privacy Policy explains how that data is handled and where it lives (in Canada, for the work itself). It is part of this agreement.

Who can accept

The person who ticks the box and creates the company account confirms that they are authorized to accept this agreement on the company’s behalf — as an owner, an officer, or someone the company has given that authority. If you are not sure you have it, ask before you accept, because from that point we treat the account as speaking for the company.

Your crew’s names

Inspection records identify the people who did the work — an inspector’s name on a report is part of what makes it a record. Under Canadian privacy law (PIPEDA and BC’s PIPA), an employee’s name in a work record is personal information, and the duty to tell employees how their information is used sits with their employer.

So the split is: your company is responsible for telling its crew that the inspection records they produce — including their names — are stored with Butterfly, and we are responsible for handling those records as the Privacy Policy promises: no analytics, no advertising, no resale, stored in Canada.

Whose data it is

Your company owns its inspection data — not us, and not the individual who captured it. We access it only to operate the service, to fix a problem you have asked us to fix, or where the law requires it. We do not sell it, rent it, or use it to train anything.

You can export your records from the service at any time, and if you leave, you take your data with you — deletion is built into the app and described in the Privacy Policy.

Your responsibilities

The service, honestly

Butterfly is currently free to use. If we introduce pricing, we will tell you before it applies to you. Not paying will mean losing access to paid features — it will never mean losing your data: your records stay readable and exportable, and field capture is never held for ransom.

Butterfly is built to work offline, and work you capture is saved on the phone first. Until a phone has synced, its work exists only on that phone — so a lost or destroyed device can mean losing the work on it. The app shows what is waiting to back up; keeping devices synced is part of using the service well.

We work hard to keep the service reliable, but we are a small operation and we will not pretend otherwise: the service is provided “as is”, without warranties of uninterrupted or error-free operation. To the maximum extent the law allows, we are not liable for indirect or consequential losses, and our total liability to your company is limited to the amount your company paid us in the twelve months before the claim arose.

Ending this agreement

You can stop using Butterfly at any time — export what you want to keep, then delete your accounts from inside the app. We can suspend or close accounts that break these terms, and if we ever discontinue the service, we will give you notice and a reasonable window to export your records first.

Governing law

This agreement is governed by the laws of British Columbia and the federal laws of Canada that apply there, and any dispute belongs to the courts of British Columbia.

Changes to these terms

If we change these terms we will update this page and the version date at the top. If a change is significant, we will tell you before it takes effect. Continuing to use the service after that is acceptance of the new terms.
